Independent Adult Children

Solicitors Henry Straw and Georgina Coates present on Independent Adult Children claims under the 1975 Act. This session is a further deep dive in to the Act, looking at these types of claims in particular, reviewing a real life case and how we tackled it.

Trainee Solicitor, Hannah Coton-Smith and Partner, Cara Hough will cover off conducting litigation as an Executor, looking in detail at the case of Bowser v Smith [2023] EWCA Civ 923 which serves as a reminder of the cost risks involved in the aggressive pursuit of a flawed claim.

  • An overview of the facts of the case and why it went so far as the Court of Appeal;
  • Consideration of the comments made by the Judge and ways to try to avoid inviting the same on your own future cases;
